If you are being sued in an ADA/accessibility lawsuit and are not already represented by an attorney as to the matter, our best suggestion is that you speak to one of the growing number of lawyers who have handled at least 50 ADA/accessibility lawsuits; a number of lawyers have defended hundreds of them. But there are probably other things you need to know as well:

You should be aware that, as of 31 October 2008, California has finally posted the names of Certified Accessibility Inspectors ("CASp Inspectors") who can help you identify conditions at your business or property which are commonly known to trigger ADA/accessibility lawsuits; see www.CASpInspections.com for more information. There are important advantages for businesses which pass a CASp inspection in the unlikely event they are later sued. It is very important that you retain any inspector through an attorney representing you to protect the inspection and findings in the event of current or future litigation.
